					<description><![CDATA[While in recent years the state has seen a growing push by outside groups to use initiatives to implement policy changes while circumventing the state legislative process entirely, these efforts have rarely been successful in ultimately making the ballot. What has become more common practice is for proponents to use an eligible ballot measure to put pressure on the Legislature and Administration to broker a deal that will achieve the proponent’s aims while also pulling their initiative from the ballot before it officially qualifies. This was particularly the case this year, where we saw an unusually high number of measures pulled from eligibility after an agreement was reached just days before the June 27th qualification deadline.]]></description>

					<description><![CDATA[We wanted to give you a little detail on the agreement reached last night on the State Budget that will be acted upon very swiftly in the coming days.

The agreement includes the revenue and taxation proposal adopted by the Legislature, which speeds up the suspension of some tax credits and increases general fund revenue by about $5 billion in the budget year compared to the Governor’s May Revision. With overall general fund revenue at about $211 billion in the budget year, there is a corresponding increase to the Proposition 98 Guarantee to $115.3 billion.]]></description>

					<description><![CDATA[Governor Newsom’s January Budget recognized a significant deficit compared to the revenue and expenditure numbers used in the 2023 Budget Act, but within a couple months both the Department of Finance (DOF) and Legislative Analyst’s Office (LAO) announced that revenues were falling sharply below even the numbers used in January. Fortunately, we have had better news recently, and while we are still likely to see a revenue shortfall in the May Revision (compared to the Governor’s January estimates) the magnitude of the shortfall should be more manageable than feared just a few weeks ago. We are hopeful this could mean we are able to mitigate or even avoid cuts to ongoing K-14 programs in the budget.]]></description>

First, the big news: earlier, the Legislative Analyst had recently opined that the state’s budget shortfall (covering 3 years) would total $68 billion. Significantly, the Department of Finance estimates that shortfall to be only $38 billion. 					<description><![CDATA[CDE recently released the Expanded Learning Opportunities Program (ELO-P) Program Plan Guide, available here. 
 
According to CDE:
 
In this program plan, LEAs will describe program activities that support the whole child, and students’ social and emotional learning (SEL) and development. LEAs must operate the ELO-P pursuant to the requirements in California EC Section 46120, including the development of a program plan. The program plan needs to be approved by the LEA’s Governing Board in a public meeting and posted on the LEA's website.

					<description><![CDATA[Both the Senate and Assembly Education Committees appear to have wrapped up their work on bills that were authored in their respective houses last week, as Friday was the deadline for all bills with any fiscal impact to the state to have moved through their relevant policy committees. While technically policy committees can meet until May 14, at the time of this writing, neither Education Committee has a hearing scheduled prior to that date. We will be on the lookout for any last-minute maneuvering to get education bills heard and keep you up to date if anything changes.

					<description><![CDATA[We wanted to make sure you were aware that Governor Newsom announced an aspirational date of June 15th to reopen the economy and do away with the state’s current tiered blueprint. The California Department of Public Health provided a bit more detail on the announcement, and that information can be found below. You will find a particular note for schools that reads, “Schools and institutions of higher education should conduct full-time, in person instruction, in compliance with Cal/OSHA emergency temporary standards and public health guidelines.” Mask mandates will stay in place even after the 15th.

There is not a whole lot of detail, but five areas referenced in the document are encouraging. The first point is that they are supporting a record level of one-time and ongoing resources to schools as a result of the increases to the Proposition 98 guarantee from a dramatically rebounding economy. 					<description><![CDATA[We wanted to clarify some of the information provided on our “Spending Deadlines” slide from our American Rescue Plan Education Briefing last week. The May 2021 deadline referenced under “ESSER Fund (CARES Act)” actually applies to the portion of Learning Loss Mitigation funds provided to LEAs out of the Coronavirus Relief Fund, not to ESSER I funding. The deadline for an LEA to obligate its ESSER I funding is still September 30, 2022.

					<description><![CDATA[The IQC has posted the revised draft of the Ethnic Studies Model Curriculum for its final 45-day public comment period, which concludes January 21, 2021. Open for the link to the revised draft. This draft reflects the changes adopted at the IQC’s November 18-19, 2020 meeting.
 

Following this 45-day public comment period, the draft will be presented to the SBE, likely at its March 2021. Meeting. Under current law, the SBE is required to take final action on the model curriculum by March 31, 2021.

				<title><![CDATA[Assembly Examines School Reopening, Senate, Distance Learning, Nov. 2, 2020]]></title>

					<description><![CDATA[On October 27,2020 the Assembly Budget Subcommittee on Education held a hearing to look specifically at the question of the state’s role in assisting schools to reopen during, and hopefully after, the COVID-19 pandemic. There was such great interest in this hearing that several members who do not actually sit on the budget subcommittee listened in and asked questions of the panelists. While much of the hearing focused on things the state has already done to assist schools generally during the pandemic, a few key takeaways, discussed below, could inform policies and guidance coming from both the Legislature and other state departments like the California Department of Education (CDE), the California Department of Public Health (CDPH), as well as the Newsom Administration.]]></description>

As we have come together through virtual meetings and emails since March, many positive connections have been either made or deepened. One outcome of our virtual roundtables was an emergency meeting of the CAWS Board in order to determine how best to address the numerous concerns voiced during those shared conversations. On behalf of the CAWS Board and California IB schools, I sent an email outlining areas of concern to Haif Bannayan Director, Outreach & Conferences IBO.
Haif was very pleased to get such specific information from California and assured me that he was going to share it and his team would address our concerns as rapidly as possible.

				<title><![CDATA[Legislature Passes Budget, Agreement with Governor Still Pending - June 16, 2020]]></title>

					<description><![CDATA[As expected, the Legislature passed an “on-time” budget today, despite not having a budget agreement in place with the Governor. The main budget bill, SB 74, as well as a small number of budget trailer bills, will now be submitted to the Governor. This action allows the Legislature to meet its Constitutional June 15th deadline to pass a balanced budget, but it does not mean that we have a final budget in hand. We won’t have that final budget until the budget negotiations between the two parties are completed and this budget is amended.]]></description>

				<title><![CDATA[LAO]]></title>

					<description><![CDATA[This morning, the Legislative Analyst’s Office (LAO), the non-partisan budget advisor to the Legislature, released a Spring Fiscal Outlook looking ahead to the 2020-21 fiscal year. Although the LAO recognizes the dramatic economic impacts of the COVID-19 crisis, and corresponding deep budget deficits, their fiscal assessment is significantly less dire than the Fiscal Update that we wrote about yesterday, after it was released by the Governor’s Department of Finance (DOF). DOF projected a $54 billion budget shortfall, while the LAO projects the shortfall to be between $18 and $31 billion. It is important to note that these shortfalls assume no cuts to K-14 education – that is, continued funding at the 2019-20 level, adjusted for growth and COLA.

LAO acknowledges that we are in a deep recession, but also notes that we are facing large uncertainties about many factors – from how long the recession will last, and what its revenue effects will be, to the extent of federal relief aid. Because of this uncertainty, LAO approaches its estimates of the impending budget deficits by building two scenarios – a somewhat optimistic U-shaped recession scenario (where some recovery begins this summer, but faster recovery would begin in 14 months), and a somewhat pessimistic L-shaped recession (where gradual recovery doesn’t begin for 14 months, and full recovery isn’t until 2023).

Under the U-shaped scenario the state would have to address an $18 billion budget shortfall, while under the L-shaped scenario that shortfall would be $31 billion. In both cases those projected budget deficits fall mainly in the 2020-21 fiscal year. The LAO notes that California should have about $9.5 billion of federal funding from the CARES Act to address the deficit in 2020-21. The LAO also points out that under each scenario, the budget problem persists into the future at least until 2023-24. Over that entire recession period the total deficits will amount to $64 billion and $126 billion for the U-shaped and L-shaped scenarios, respectively.

Under the U-shaped scenario the LAO projects a significant decline in the Proposition 98 Guarantee equal to $13.3 billion lower over the three budget years (2018-19, 2019-20 and 2020-21) as compared to that projected in the Governor’s January Budget. Under the L-shaped scenario that decline would be $18.6 billion. In both cases these declines primarily occur in the 2020-21 fiscal year, which reflects the drop in General Fund revenues related to the recession.

LAO’s projections are based on a number of assumptions and projections:

2020-21 revenues and other resources fall by $26 billion and $39 billion, under the two scenarios, respectively
Direct COVID-19 costs amount to $7 billion, 75% of which is covered by federal relief funds
The state suspends deposits into the Rainy Day Fund for 2020-21
No cuts are made to K-14 funding in the current year, and flat funds schools in 2020-21 at that 2019-20 level adjusted for growth and COLA
Federal cost sharing for Medicaid programs saves the state $6 billion in costs
All discretionary funding proposals in the January budget are dropped

The LAO does enumerate additional actions that could be taken to reduce the size of the projected budget deficit, including:

Securing additional federal funds
Eliminating COLAs, including the K-12 statutory COLA
Funding K-14 at the Proposition 98 Guarantee level in 2020-21, rather than flat funding from 2019-20
Clawing back and reverting to the General Fund any funds appropriated in 2019-20 that have not been expended
Revising baseline spending in some areas of the budget, though this could result in a reduction in services

As noted above, the DOF’s release yesterday projected a much larger budget problem (a $54.3 billion shortfall) than is reflected in the LAO’s update. However, the primary reason for that is that DOF focused on gross changes in the budget as a result of revenue declines and cost increases, while the LAO projections focus more widely on the net effects of what we are facing. In addition, the LAO notes that the DOF is projecting:

Slightly lower revenues than even the LAO L-shaped scenario
Billions of dollars more in increased caseload-driven costs (e.g., social program costs related to the recession)
That the budget continues to include all of the discretionary funding proposals that the Governor included in his January Budget
That spending for Proposition 98 remains unchanged from the January Budget

The top take-aways from these two days of fiscal updates from LAO and DOF is that we are facing a budget year, and probably a series of years of budget deficits, where funding for K-12 education suffers to some degree as a result. However, it is also clear that we are facing an unprecedented level of uncertainty over the state’s economy, tax revenues and budget circumstances, and that uncertainty falls on us as we are trying to craft budgets going forward.

We will continue to keep you advised as the May Revision is released next week, and as budget discussions progress through the Legislature. We will have some idea about next year when the Legislature passes its budget by June 15, but we also know that the June 15 budget will not be the last word. As happened in 2008-09, we expect to see later budget revisions as more information becomes available with respect to both revenues and costs. Stay tuned for more information over the coming months.
